Prevent Financial Stress for Your Partner

If you were to pass away without a will, your partner could face financial stresses at an already difficult time.

This is especially true for unmarried couples, who are not entitled to inherit each other’s possessions under the law.

When you have a will, your partner can receive the inheritance from you.

Secure Your Inheritance

When it comes to your assets, you alone should decide where they go.

It is important to have a will, so you can secure your valuable possessions even when you have passed.

All the things you have worked for won’t go to waste because your family and friends will inherit them in the future.

Four reasons why you need a Will

  1. A will makes it much easier for your family or friends to sort everything out when you die – without a will, the process can be more time-consuming and stressful.

  2. If you don’t write a will, everything you own will be shared out in a standard way defined by the law – which isn’t always the way you might want.

  3. A will can help reduce the amount of Inheritance Tax that might be payable on the value of the property and money you leave behind.

  4. Writing a will is especially important if you have children or other family who depend on you financially, or if you want to leave something to people outside your immediate family.

The loss of a family member or friend is an upsetting moment and can be stressful especially if several problems need to be solved.

The most important part is dealing with their personal affairs and sorting out their estate in some case scenarios the beneficiaries may try to get things done as soon as possible so that the funeral costs will be covered by the estate.

Here at Genesis Wills and Estate Planning Ltd, we understand that when you are applying for probate it is a time-consuming process, especially at the time when you are grieving.

Our probate professionals will take care of your application so that it is easy for you to start the process of being able to sell claims and distribute any assets.

There are different trusts involved and each and every individual trust has a great meaning as to how they can benefit you in your daily life these trusts are:

Discretionary Trust

  • Protective Property Trust
  • Flexible Life Interest Trust
  • Disabled & Vulnerable Persons Trust
  • Right to Occupy Trust
  • Asset Protection Trust

Lasting Power of Attorney

What is a Lasting Power of Attorney?

A Lasting Power of Attorney is if you are unable to look after any of your assets you can appoint someone to deal with your financial affairs. This will save you less hassle and the person you have appointed to look after your affairs will handle them correctly.

If you were to lose mental capacity without having an LPA then your family has to apply to the Court of Protection so that a deputy can be arranged to be able to deal with your financial affairs. This job is a time-consuming and expensive procedure and costs thousands of pounds.

You can create two kinds of LPA:

  • Health and Welfare LPA
  • Property and Financial Affairs LPA

Who can make an LPA?

Anyone over the age of 18 can make an LPA

Disabled and Vulnerable Persons Trust

If you are looking after a person who is disabled and not able to manage their financial affairs then you will need to apply for a Disabled & Vulnerable Persons Trust.

If the right plan of action is not put in the correct place then the local authority can stop the vulnerable person funding.

Mrs. Smith,

Such a professional, helpful, and reliable service, I was so grateful for the care and attention offered. They would phone me to ask if I needed further assistance in writing my Will, and in my opinion, went way beyond exceptional. Thank you, Julie, from Yorkshire Wills & Probate Company.

Mr. Jones,

A no-problem transaction (requirements were relatively straightforward) and Very prompt service.
